Islamabad High Court rules gifts given to spouse cannot be reclaimed

ISLAMABAD: Justice Mohsin Akhtar Kayani of the Islamabad High Court has remarked that gifts given to a wife cannot be taken back by the husband. The comments came during the hearing of a case filed by a husband, Muhammad Shaban, challenging certain property matters.

Justice Kayani stated that reclaiming a gift is inappropriate, comparing it to “spitting and then licking it,” and emphasized that such actions are not permitted under Islamic principles.

The court reserved its decision on the husband’s appeal, which will be announced later.

This ruling reinforces that gifts exchanged between spouses carry a legal and ethical sanctity, preventing their unilateral retrieval.
