LHC Justice Syed Farhad Ali Shah ruled that a compromise cannot entitle suspects to bail in an honour killing case.
LAHORE: Lahore High Court Justice Syed Farhad Ali Shah has rejected a compromise in an honour killing case and dismissed the bail petitions of two suspects accused of killing an 18-year-old woman.
The court rejected the bail applications filed by Muhammad Nasir and Parvez, who are accused of opening fire on 18-year-old Najman Mai and killing her in the name of honour.
In his decision, Justice Syed Farhad Ali Shah held that a compromise in an honour killing case does not give an accused a right to bail, establishing an important legal point regarding offences committed in the name of so-called honour.
The judge observed that honour killing is a non-compoundable offence, meaning it cannot be settled between the parties through a compromise in a manner that would entitle an accused to relief from the court.
Justice Farhad Ali Shah further stated that the law does not permit any person to take another person’s life in the name of honour.
The decision also noted that neither Pakistani law nor religion permits killing in the name of so-called honour.
According to the ruling, honour killing is contrary to the fundamental right to life and liberty guaranteed under Article 9 of the Constitution.
