Constitutional Court sets aside the previous Monal Restaurant demolition ruling as Justice Hassan Azhar Rizvi raises questions over the reasoning and contents of the earlier judgment.
In a significant development, Pakistan’s Constitutional Court has set aside the previous decision that ordered the demolition of Monal Restaurant, a ruling issued during the tenure of former Chief Justice Qazi Faez Isa.
During the proceedings, Justice Hassan Azhar Rizvi made strong observations regarding the earlier judgment, stating that several important aspects had not been taken into consideration. He remarked that the previous verdict contained material that had not even been discussed during the court proceedings, adding that the Constitutional Court would not issue an emotional decision.
Justice Rizvi also noted that the court had expressed displeasure when the case and subsequent review petition were filed. He emphasized that the Constitutional Court would decide the matter strictly on the basis of the record and arguments presented before it.
Representing Monal Restaurant, Advocate Ahsan Bhoon praised the court for thoroughly examining the case. In response, Justice Rizvi advised counsel not to compliment the bench, stating that the court would issue its ruling only on the basis of what had been argued during the hearing. He further remarked that judicial decisions should not include “Alif Laila stories” or matters beyond the scope of the proceedings.
