The Peshawar High Court has directed the attorney general and Khyber Pakhtunkhwa advocate general to submit their responses within 14 days to petitions challenging the imposition of governor’s rule and emergency.
The Peshawar High Court has issued notices to the attorney general and the advocate general of Khyber Pakhtunkhwa over petitions challenging the imposition of governor’s rule and emergency in the province, directing the parties to submit their responses within 14 days.
According to the written order issued after the previous hearing, the court has adjourned further proceedings until Nov. 10.
The written order stated that the assistant attorney general had raised objections to the maintainability of the petitions, questioning whether they could be heard by the court.
The petitioners, however, argued that the emergency had been imposed without approval from the provincial assembly. They also contended that the president did not have substantive evidence to justify the imposition of emergency in the province.
The petitions further address the deployment of the armed forces under Article 245 of the Constitution, which provides for their assistance to civil authorities.
According to the petitioners, the armed forces were called in under Article 245 to assist the civil administration. They maintained that the provincial government holds the authority to request the deployment of the military under this constitutional provision.
The court, in its written order, directed the attorney general and the Khyber Pakhtunkhwa advocate general to file their responses within 14 days.
The case will now be taken up again on Nov. 10, when the court is expected to consider the matter in light of the proceedings and responses submitted by the parties.
The petitions challenge the constitutional basis for the emergency and governor’s rule in Khyber Pakhtunkhwa. The petitioners’ arguments and the objections raised by the government’s law officer form part of the legal proceedings before the high court.
