An Indian national Karnal Singh has filed a fresh constitutional petition in the Lahore High Court seeking the annulment of his wife Sarabjeet Kaur’s marriage with a Pakistani citizen Nasir Hussain.
Filed through legal counsel, the petition argues that Sarabjeet converted to Islam and contracted marriage with Hussain without first obtaining a lawful divorce from Singh. The petitioner contends that the subsequent marriage violates principles outlined by Pakistan’s superior courts, particularly the Federal Shariat Court regarding conversion and remarriage.
According to the plea a married non-Muslim woman must secure a judicial divorce under her domestic law before entering a new marriage. It further states that required procedural steps, including inviting the former spouse to embrace Islam and observing a waiting period, were not fulfilled.
The petition maintains that the earlier marriage remains legally valid and alleges that cohabitation during its subsistence constitutes an offence under Islamic law. Singh has requested the court to declare the later marriage void and initiate legal proceedings.
Additionally the petitioner has sought Sarabjeet’s deportation under the Foreigners Act 1946 citing alleged visa violations. The case continues to draw attention due to its legal and cross-border implications.
